Terms of Service

Welcome to Kinetix Clips ("Clips," the "Service"), operated by Kinetix AI LLC ("Kinetix," "we," "us"), San Diego, California. By using kinetix.film/clips or clips.kinetix.film, you agree to these Terms. If you don't agree, please don't use the Service — no hard feelings.

1. What the Service is

Clips turns text ideas you submit ("Prompts") into short AI-generated videos ("Outputs") using automated direction, editing, and third-party video-generation models. AI is a creative collaborator, not a photocopier: Outputs vary between renders, may contain visual artifacts, and may resemble other users' Outputs from similar Prompts. Render times are estimates, not guarantees.

2. Who can use it

You must be at least 13 to use the Service and at least 18 (or the age of majority where you live) to make purchases. If you're under 18, use Clips only with a parent or guardian's permission. You're responsible for activity under your account and for keeping your credentials secure.

3. Pricing and payment

Clips are priced per second of finished video, starting at $0.50/second, with higher-priced tiers for higher quality. The exact price is always shown before you pay. Payments are processed by our payment processor; we don't store your full card details. Because rendering consumes real compute the moment you order, completed renders are generally non-refundable — but if a render fails or arrives broken, contact us and we'll re-render or credit you. Where the law requires a refund, the law wins.

4. Your content

Your Prompts stay yours. As between you and Kinetix, you own your Prompts and, to the fullest extent permitted by law and subject to these Terms, the Outputs you pay for. You can download, post, and monetize your Outputs. You grant us a limited license to host, process, and display your Prompts and Outputs as needed to operate, secure, and improve the Service (including safety review). We don't sell your content and we don't claim your ideas.

5. Acceptable use

Don't use Clips to create or attempt to create:

We may decline any Prompt, remove any Output, or suspend any account that violates these rules. Automated filters plus human review back this up; declined renders that never ran aren't charged.

6. AI transparency

Outputs are AI-generated video. You're responsible for how you use and label them. When you share Outputs in contexts where people could mistake them for real footage, disclose that they're AI-made. Some platforms and jurisdictions legally require such disclosure — that compliance is on you.

7. Copyright complaints (DMCA)

If you believe content on the Service infringes your copyright, email hello@kinetix.film with (a) the material and its location, (b) your ownership claim, (c) your contact info, (d) a good-faith statement, and (e) your physical or electronic signature. We respond to valid notices and terminate repeat infringers.

8. Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY OUTPUT WILL MEET YOUR EXPECTATIONS — TASTE IS SUBJECTIVE AND ROBOTS ARE ARTISTS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINETIX WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

10. Indemnification

You'll defend and hold Kinetix harmless from claims arising out of your Prompts, your use of Outputs, or your breach of these Terms — including claims that your Prompt asked for something you didn't have rights to.

11. Termination

You can stop using Clips anytime. We may suspend or terminate accounts that violate these Terms or create risk for the Service or others. Sections 4 and 7–13 survive termination.

12. Governing law and disputes

These Terms are governed by California law, without regard to conflict-of-law rules. Before filing any claim, contact us at hello@kinetix.film — most issues get fixed faster than a render. Disputes that can't be resolved informally will be brought in the state or federal courts of San Diego County, California, and you consent to their jurisdiction. Small-claims court remains available to both of us.

13. Changes

We may update these Terms as the Service evolves. Material changes get a notice on this page with a new effective date; continued use after changes means acceptance.
